While not expressly considered as such, either in the trial reasons (linked from the appeal case) or in the appeal reasons, this case is nicely illustrative of the doctrine of similar fact evidence in the context of harassment emanating from a very nasty neighbour dispute. A pattern of harassment and abusive treatment by a party was applied to infer a specific extreme act of harassment for which no direct evidence existed.
