Municipalities Act (PEI)(current to 15 May 2016)Note Re Application of the Municipalities Act ('MA')
The MA sets out the jurisdiction that municipalities have to make by-laws respecting animals. With the exception of some references to dogs, this jurisdiction encompasses both wild and domestic animals.

PEI's Municipalities Act allows municipalities to make by-laws respecting [MA 30, 64(n)] :- "regulating the keeping of animals in residential and commercial zones",
- "controlling animals wandering at large",
- "for the prevention of cruelty to animals",
- "establishing animal pounds and prescribing impoundment fees",
- "concerning the functions of an animal control officer".
The cruelty jurisdiction is a marked and progressive expansion of the tradition over nuisance and dangerous animals (typically dogs). As well, the jurisdiction to regulate the "the keeping of animals in residential and commercial zones" has broad potential to control exotic and other wildlife animals kept as pets, or in facilities such as zoos and circuses.
