Line Fences (Ontario)


COMMENT

This topic, while it may seem to bear on most neighbour fence disputes, is mostly only about fences that track an undisputed property line. Many, if not most, fence disputes are actually about trespassing fences - either to be dealt with under civil trespass (essentially tort) law or the Registry Act's remaining adverse possession doctrine. Also, the 'line fences' regime set out here and in the Line Fences Act (LFA) is a little-used municipal-based regime which is optional to any municipality - so you will see relatively little case law.

I have a soft spot for line fences law though, as it was the first 'legal guide' that I wrote some 25 years ago to test out the concept of this website. Sorry that the law isn't clearer even after all this time.
