In this case the Court of Appeal engaged in an extended consideration of surveillance video in a motor vehicle accident case, including it's treatment in documentary discovery, it's privileged status, and how and when it may be used at trial. The principles discussed apply broadly to conflicting issues of privilege, disclosure and subsequent use of such conflicted evidence at trial [paras 33-116].
