Civil Litigation - Originating Process

. Boodoo v. Merrick

In Boodoo v. Merrick (Ont CA, 2020) the Court of Appeal considered and validated service of a Statement of Claim where the defendant, having been served a year after the issuance of the claim, did not allege any details of prejudice caused by the delay.

See R14.08(1): "Where an action is commenced by a statement of claim, the statement of claim shall be served within six months after it is issued."
