In Stelmach Project Management Ltd. v. Kingston (City) (Ont CA, 2022) the Court of Appeal considers the unusual municipal 'rule against circumvention' [MA s.15], which - while allowing dual methods to achieve municipal goals - insists that necessary procedures not be circumvented [here, municipal act procedures used to achieve Development Charges Act (DCA) goals] [paras 20-56].
