In Canadian Energy Services L.P. v. Secure Energy (Drilling Services) Inc. (Fed CA, 2025) the Federal Court of Appeal dismissed a patent appeal, here from "a judgment of the Federal Court ... declaring inventorship and ownership of a patent for a polymeric drilling fluid used in drilling for oil".
Here the court addresses the ownership of a patent where the inventor is an employee:
[99] An employer can establish ownership of intellectual property rights in an invention created by one of its employees if there is a formal agreement setting out that the employer retains these rights or if the employee was hired for the express purpose of inventing: Brown v. Canada, 2016 FCA 37 at para. 34. ....
